Islamabad: Secretary interior has submitted his reply on non-arrest of former president Pervaiz Musharraf in High Treason Case stating that Interpol has rejected Pakistan plea for arresting former president.
Islamabad special court had summoned secretary interior on non-arrest of former president despite issuance of his non-bailable arrest warrants during previous hearing of the case on August 20.
A two-judge bench of special court Islamabad headed by Justice Yawar Ali took up the High Treason Case against Musharraf for hearing on Wednesday.
During the course of hearing secretary interior appeared before court, filed his reply while taking the plea that government had requested Interpol officials to bring back Musharraf but they rejected the plea.
According to secretary interior, Interpol officials said that High Treason Case didn’t come under their legal jurisdiction.
On secretary interior clarification, court issued orders to file Interpol reply upon which secretary replied that Interpol reply will be submitted today.
Justice Yawar Ali asked, “Could Pervaiz Musharraf statement under section 342 be recorded through Skype?
Justice Yawar further asked, “can court proceeding go ahead without recording statement under section 342?.
The court directed that arguments be given on next hearing in connection with recording statement on skype or taking forward the proceedings without it on next hearing.
On the other hand, special court has accepted plea of prosecution team head Akram Sheikh in connection with his separation from the case.
Akram Sheikh took the plea that it will be decided by the sitting government to run or otherwise the case while the counsels of Musharraf in this have now come in power and interior ministry will decide better on this count.
Secretary interior informed court that he had written a letter to Interpol for bringing back Musharraf.
On it Justice Yawar remarked, “Why you didn’t attach the copy of letter with reply?
Secretary interior replied that copy of letter will be submitted before court. Interpol rejected our plea for issuing red warrants of Pervez Musharraf. Interpol has said they do not issue red warrants in political cases.
Justice Yawar Ali observed that court wants to take this case to its logical conclusion. Please present the copy of Interpol letter.
Justice Yawar Ali while inquiring secretary interior remarked, “Does federal government want to take back High Treason Case against Musharraf?
On it Secretary Interior replied that Prime Minister has kept the slot of interior ministry with himself but the matter of withdrawing the case has not been discussed. Musharraf case is in the court and law will take its course. .
The appointment of new prosecutor will be made in consultation with attorney general and law minister.
The court has adjourned the hearing till September 10.
