ISLAMABAD:  Islamabad High Court (IHC) has declared non maintainable a petition filed by the PTI against a member of Election Commission (EC).

PTI leader Fawad Chaudhry had filed petition against the induction of member EC Nisar Durrani.

The case came up for hearing before single bench of IHC led by Chief Justice (CJ) Athar Minallah here Monday.

Abuzar Suleman counsel for the petitioner appeared in the court.

The CJ IHC remarked member election commission is a constitutional post and this court will not interfere in the matter of any constitutional institution. The procedure for removing member of EC from office is laid down in the constitution.
Abuzar Suleman, counsel for the petitioner told the court when the appointment is illegal then the court can use its constitutional jurisdiction . The member EC holds a second government post too.

The CJ IHC remarked a separate procedure is laid down in the constitution for removing member EC.

The court dismissed the petition declaring it non maintainable.
