ISLAMABAD: The Supreme Court (SC) has nullified decision of forced retirement of 13 judges of KP subordinate court’s and referred the case to judicial services for deciding the case again.
A 3-member bench of SC presided over by Chief Justice of Pakistan (CJP) Gulzar Ahmed took up the case for hearing Monday.
Justice Ijaz ul Ahsan remarked “ judge Shah Hussain assets have increased three folds within two years. Judges assets increased from Rs 6.4 million to over Rs 35 million till his becoming civil judge. Doubt was expressed about the reputation of judge in the report for three years consecutively.
Counsel for Judge Shah Hussain told the court allegation on assets beyond known sources of income was not leveled in show cause notice. My client mentioned the market value of his property in performa. Assets were the same but market value was mentioned higher. Our appeal pleas against the respective committee of Peshawar High Court is pending hearing.
It is pertinent to mention here Peshawar High Court respective committee had sacked 13 judges of KP judiciary which was later converted into premature retirement by judicial tribunal.
The judges had filed appeal pleas in SC against tribunal decision.
The SC has now declared null and void the decision of forced retirement of 13 judges from subordinate courts and sent the case to judicial services for a fresh decision maintaining the tribunal should decide the appeal pleas of judges of subordinate courts within 3 months.
