Calls for early revocation of the decision, if any, to this direction,

Altaf Hamid Rao,

MIRPUR (AJK): (Parliament Times) Azad Jammu Kashmir Supreme Court Bar Association has expressed grave concern over the recent reported decision of the government of Pakistan about the disposing off / sale of the ancient Jammu & Kashmir State property located in various parts of the country, an AJK SCBA press release said.

Expressing dismay over the above reported decision taken about the sale of Pakistan-based J&K State property, in the recent meeting chaired by the Prime Minister of Pakistan, the AJK SCBA Secretary General Javed Najjam-us-Saqib Advocate said that the right of ownership of the Pakistan-based Jammu Kashmir state property directly belonged to the Jammu Kashmir State under the interim constitution – 1974 of Azad Jammu Kashmir. The J & K State property, he continued, was given only for the administrative and management control of the ministry of Kashmir affairs under ‘Administration of Kashmir Property Ordinance 1961’ with the condition that the Government of Pakistan would not have any right to sale / dispose off the property in any way.

The AJK SCBA Secretary General further pointed out that in 1985 the centuries old Jammu Kashmir State property located in Pakistan were of the worth of Rs. 8500 billion, which, he added, has now exceeded to the value of over Rs. 25000 Billion. “Since the people of Jammu & Kashmir state are the real owner of this property and as such, the Jammu Kashmir people living the world over in general and the legal fraternity of Azad Jammu Kashmir in particular, reject this reported decision”, Saqib declared.

Javed Najjam-us-Saqib Advocate also invited the attention of the power corridors and other authoritative sensitive institutions towards the above situation as saying “after August 5, 2019 sinister Indian act, any alleged move of selling out the Pakistan-based Jammu Kashmir state property, by the Govt. of Pakistan, would raise question mark on the sincerity of Pakistan over its ever-lasting wishes of the peaceful solution of Jammu & Kashmir in line with international norms and commitments”.

The AJK SCBA Secretary General also demanded of all above authoritative quarters of the country to immediately perform their due role to ensure early withdrawal of the above alleged official decision about disposal off the State property to end the prevailing unrest and chaos among Kashmiris, he concluded, the press release said.

Saqib demanded of Azad Jammu Kashmir government to immediately move for performing its due legal and constitutional responsibility through exercising legal and constitutional steps to ensure the protection and maintaining the due status of the J & K State Property in the backdrop of their historical, legal and constitutional framework being the property belonging to the internationally-acknowledged disputed Jammu & Kashmir state, he emphasized.
