ISLAMABAD: Chief Justice of Pakistan (CJP) has remarked that Azam Swati should resign from his office.
CJP further remarked “ Azam Swati is so egoist that he got an IG Police transferred. He got the parents and their children arrest and sent them to jail. Will such people run the country. This offence on his part is against the state.
CJP gave these remarks while presiding over a 3-member bench of SC Friday during the course of hearing of suo motu notice in connection with transfer of IG police.
IG Jan Muhammad appeared in the court and he excused himself from continuing to perform duties as Islamabad IGP and told the bench, “I cannot work given the present circumstances and request the court to grant permission on my transfer.”
CJP remarked , Ok, if he is saying then it is permitted.
Counsel of Azam Swati appeared in the court during the hearing of the case and presented apology wherein police was held responsible for the incident.
CJP while rejecting the apology remarked “ we are constituting JIT on this matter which will include the best officers of NAB, IB and FIA.
CJP inquired “ tell me IG Sahib, why did you not register case.
IG replied I was out of country.
CJP remarked “ can a second case be registered in this matter. If it is so then register it today. Such treatment be meted out to him what is meted out to a common citizen. Only this is rule of law.
The affected family appeared in the court taking the plea that “ I am a poor man. Injustice was done. But I forgive Azam Swati for the sake of Pakistan.
CJP remarked “ we will get investigate the matter in our own way. We will see how Azam Swati accumulated assets. It will be also seen who is behind the case of Azam Swati. Is he the leader whom we should tolerate. Why we should tolerate him being a Qazi.
Ali Zafar counsel for Azam Swati said “ incident has occurred. We don’t deny it. The facts behind the incident should also be reviewed.
Justice Ijaz ul Ahsan remarked “? matter is not this that incident has happened. But we have to see why the state machinery was misused.
CJP remarked “we highly respect the parliament. But we will not allow the use of power this way. Righteous people are needed to run this country.
The counsel for Azam Swat for the third time prayed the court to forgive.
CJP while issuing notice to Azam Swati remarked “ we apply article 62-1 -F .
He further remarked “ Azam Swati misused his powers. He should explain as to why his membership of parliament be not abolished. This case comes under article 62/1-F
Barrister Ali ZAFAR appeared on behalf of Azam Swati.
CJP while admonishing him remarked “ Ali Zafar, you come here to appear on behalf of every powerful person. Tell me your license should be suspended for how many days..
Later SC constituted JIT in IG transfer case comprising Ahmad Rizwan from IB, Mir Waiz from FIA and DG NAB Irfan Mangi.
The court while rejecting apology of Azam Swati withdrew its order for not transferring IG Islamabad.
The court while ordering JIT to file report within two weeks has adjourned hearing of case for two weeks.
