Islamabad: Islamabad High Court (IHC) has reserved the judgment regarding the matter of killing of a Pakistani citizen being hit by the car of US diplomat.
Judge remarked at the inception of the hearing that the methodology of punishment in respect of a diplomat should be explained as It cannot happen as such that there is a crime but no penalty.
A single member bench of IHC consisted of Justice Amir Farooq took up for hearing the case of death of a citizen named Ateeq Baig after he was hit by the car of col. Joseph here on Monday.
Advocate Mirza Shahzad Akbar told the court during the hearing that if US allows then the trial of this crime could be started here in Pakistan. On the other hand trials of these crimes could also be conducted in America. The security of Pakistani citizens is the responsibility of government of Pakistan.
It is requested to the court to order the government of Pakistan to take action against the American diplomat, he prayed.
Pakistan should make a request seeking end to immunity for US diplomat under the clause 32 of Vienna Article. In the event of not ending the immunity, US should assure for initiating action against the diplomat and Pakistan should approach International Court of Justice (ICJ) if its compliant is not addressed, he pleaded
Later the court was told on the behalf of foreign Ministry that whatever the court gives order, it will be implemented. The court reserved the Verdict with reference to trial and placement of name of US diplomat in ECL.
