ISLAMABAD: The bench hearing high treason case against former president Pervez Musharraf dissolved after bench head Justice Yahya Afridi recused himself from hearing the case.

A 3-member special bench comprising Justice Tahira Safdar of the Balochistan High Court and Justice Yawar Ali, and presided over by Justice Yahya Afridi chief justice of Peshawar high court was hearing high treason case.

A petition was filed by the lawyers of Pervez Musharraf raising objections on Justice Yahya Afridi, head of the bench

It was said in the petition that Justice Yahya Afridi had remained counsel of former CJP Iftikhar Chaudhry. He had grudge against Pervez Musharraf, therefore, they did not expect any justice from him.

On the request of Pervez Musharraf lawyers the petition was heard in chamber. The judgment was reserved over it.

Announcing the decision Justice Yahya Afridi recused himself from the bench.

Justice Yahya Afridi wrote in his order that although this objection was incorrect that he remained counsel for former CJP Iftikhar Chaudhry. This is correct that he was a co-petitioner in the case against Pervez Musharraf’s November 03, 2007 emergency . Now when petition has been filed against it therefore, he deems it correct to recuse himself from hearing the case keeping in view the norms of justice.
