ISLAMABAD: Islamabad High Court (IHC) has remarked should court write in its verdict that state agencies have failed to do their job as per law.
The court further remarked should Prime Minister (PM), secretary defence and IG be not awarded punishment instead of an SHO on non recovery of missing person.
A single bench of IHC presided over by Justice Athar Minallah took up for hearing IT expert Sajid Mahmood wife petition in kidnapping of her husband case Friday.
Justice Athar Minallah remarked “how many intelligence agencies are operating in the country. Government JIT has given report that Sajid Mehmood has been kidnapped by state institution. Should court write in its verdict this is failure of agencies. FIR on disappearance of Sajid Mehmood was not registered for three months. Is there no responsibility of agencies.
He further remarked “an SHO was held responsible and a nominal punishment was awarded to him. As to why PM, secretary defence secretary and IG be not punished instead of SHO.
The learned judge while addressing police officers who had appeared in the court remarked “ the court can not trace out missing persons. The courts domain is to determine who is responsible. This is ineligibility of IG that he does not know that SHO is doing what under him.
He observed “ God forbid if some thing happens with son of IG then will he continue to sit this way.
Later the court sought details of household expenses of Sajid Mehmood from Deputy Attorney General.
The court expressed displeasure remarking as to why the house hold expenses of Sajid Mehmood be not recovered from chief commissioner, deputy commissioner and IG. When responsibility of every missing person will be fixed on IG then system will stand corrected automatically. When IG comes to know that responsibility will be fixed on him then he will not allow this thing to occur.
The court ordered the deputy attorney general to complete his arguments on next hearing and remarked the next hearing will be last hearing. The court can not want to prolong this case.
DSP legal Azhar Shah, SHO Shalimar police station Munir Jaffri, investigation officer and deputy attorney general Khalid Mehmood Raja appeared in the court.
They prayed the court to give more time and the court accepted this plea and adjourned the hearing of the case till January 12.
It expert Sajid Mehmood was allegedly abducted from the jurisdiction of Shalimar police in Islamabad last year and his wife has resorted to IHC in this matter;
