ISLAMABAD :(Parliament Times)  Prime Minister (PM) Nawaz Sharif’s counsel Makhdoom Ali Khan gave arguments in Supreme Court (SC) in the light of judicial verdicts on article 62.

He said that disqualification on the basis of article62 (1f) cannot be made without the declaration of any judicial forum.

“SC has already declared the article as an ambiguity and a nightmare. Can an elected prime minister be disqualified on its base?” he asked.

The court’s verdict also asserted that only the prophets can meet such constitutional standards.

“Pakistan Muslim League-Nawaz (PML-N) candidate Siddique Baloch was disqualified under this article but SC annulled election tribunal’s verdict. In general elections, returning officer rejected the nomination papers of Pervez Musharraf in light of SC decision,” he argued.

Justice Asif Saeed Khosa inquired that does the counsel wants to say that ineligibility cannot be determined without any judicial verdict.

“Declaration and disqualification cannot be held at the same time,” the judge said.

Makhdoom Ali Khan replied that his arguments are based on the same point.

He further said that Prime Minister’s National Assembly statement was also challenged in the past.

“Is this the same speech of the premiere that he delivered during the 2014 protest?” Justice Azmat Saeed questioned.

Makhdoom Ali Khan responded that speaker National Assembly had dismissed the referenced in this regard whereas his decision was also maintained by Islamabad High Court and SC
