Amid flood devastations across the province a sister has launched a struggle to seek justice for his brother in Sujawal district of Sindh, despite countless challenges and indifferent attitude of state institutions and authorities concerned. Sadaq Rasool Sheikh-Brother of Advocate Kanwal Sheikh was found dead under mysterious circumstances in the meeting area of a petrol pump where he had been working as a junior manager over the past three years, on the evening of 6th August in Sujawal. The CCTV record of the petrol pump was instantaneously removed from the DVR –Device Video Recorder and police found that the cables of CCTV installed in the meeting area were chopped. Police recovered a repeater, ammunition/pallets and blood-stained bed-sheet from the crime scene and sent it for forensic examinations. Death of a 22 years old youth sent a wave of unrest and commotion across the city. People hailing from different segments of life started reaching the crime scene and the body was moved to Civil hospital Sujawal where doctors declared his death by fire arm injury. Initially owner of the petrol pump Majeed Memon,, his two sons Ghulam Nabi and Shahbaz along with the local police were bent upon declaring it suicide but mounting pressure of Civil Society and local social organizations foiled their bid by staging massive protests across the district and finally an FIR of the incident was registered after 6 days of the incident under section 302, 109 and 34 of Pakistan Penal code and two sons of the petrol pump owner and their two employees were booked in the FIR. Soon after the incident Hyderabad Bar Association, Thatta Bar Association and Sujawal Bar Association, came out in support of their female colleague and persuaded higher authorities to take notice of the barbaric crime. The associations deplored the apathetic attitude of SHO Sujawal Ayaz Memon – who was later transferred and SSP Sujawal Syed Imdad Ali Shah, cousin of CM Sindh, who remained idle throughout the whole episode. The investigation of the case was handed over to Sub-inspector Mushtaq Phanwer but from the very beginning he looked unable to deal with the case following which complainant in the case Advocate Kanwal Sheikh moved an Application to DIG Hyderabad for appointing a dutiful and honest Investigation Officer in the case. The divisional police chief appointed a three-member committee comprising SSP THATTA, SSP SUJAWAL and DSP legal Hyderabad, the team at once seemed reluctant to give recommendations for change of investigation but involvement of Thatta Bar Association persuaded the team to forward their recommendations after which reputed officer DSP Siraj-ul-din Lashari has been handed over the investigation of the case. Until the appointment of Siraj-ul-din Lashari, the snail-pace investigation of local police could not gather enough evidence till the Bail-stage and two of the four accused were granted bail by the Districts and Sessions Court Thatta. The court pronounced its order after hearing arguments of both sides. Advocate for complainant Mr Ayaz Ali Khowaja attracted the court towards malice of police and the interference of accused in the course of investigation. He contended that investigation agency-police was blindly toeing the nail of influential accused. On the other hand Advocate Sheikh seems optimistic to attain justice in spite of several impediments. She said that her whole family had reposed trust in the justice system of this country and they were hopeful that justice would be done to them. The arrival of Mr lashari has given a new direction to this case. It would be pertinent mentioning here that two similar kinds of incident took place in the city some 3 months back and police declared those incident as suicide despite agitations by the civil society. The general public has termed the whole scenario a battle against capitalism that since long has been suppressing the voice of the feeble in Sindh.
