ISLAMABAD: Petition has been filed in Islamabad High Court (IHC) seeking staying by polls on National Assembly (NA) seat which has fallen vacant due to PTI leader Jahangir Tareen disqualification in NA-154 Lodhran.
The petition has been filed by Shahid Orakzai making election commission respondent.
The petitioner has prayed that under article 224 of the constitution during the last four months of tenure of national assembly, election can not be held on the seat of NA. Therefore election commission be restrained from holding by polls in NA-154.
He also took the plea that the successful candidate in NA-120 has not taken oath even after 100 days of her success. The public wealth was wasted in the by polls in NA-120. In the prevailing situation it makes no difference if a seat of NA remains vacant. The disqualified member is authorized to file review petition and he can be restored on his seat through the review petition. If Jahangir Tareen is restored then the by polls will stand nullified.
National Assembly will complete its tenure on May, 31, 2018. An interval of 120 days falls during the two sessions of NA. Therefore, any candidate who succeeds in February 12 by polls in NA-154 will not be able to take oath.
