ISLAMABAD: Islamabad High Court (IHC) has reserved judgment on the petition filed against disqualification of member of assembly due to inclusion of his name in 4th schedule.

Justice Amir Farooq of IHC took up for hearing petition filed by an MPA from KP Thursday.

Senior lawyer Babar Awan appeared on behalf of Shah Muhammad, an MPA from PK-89 Bannu in the court.

He argued recording name in 4th schedule runs contrary to basic human rights. Election Commission disqualified him being his name included in 4th schedule. DPO gave him clearance certificate before filing nomination papers by him. Election commission can not disqualify member of assembly whose name is placed in 4th schedule.

He prayed the court to set aside election commission orders.

The learned judge remarked the court will review legal aspect.

The counsel for petitioner further said a member of assembly can be disqualified only under article 62 and 63 of the constitution.

The court reserved the judgment after hearing the arguments.
