Islamabad: A constitutional petition has been filed in Election Commission of Pakistan (ECP) seeking immediate postponement of presidential polls.
As per media reports, ECP has been told that the said election should have taken place before 24th August according to the article 41 of the constitution because the elections of National Assembly (NA) were held on 25th July and according to constitution, presidential polls should be held within 30 days of election of assembly.
It was made clear on ECP that the previous Assembly was dissolved on 31st May and presidential election was not possible till 25th July because NA is major part of Presidential Electoral College.
It was further told to ECP that secretary ECP committed a serious mistake in reading the constitutional clauses regarding presidential polls due to which presidential election could be controversial.
President of Pakistan is out of the country and he has not shown his intention regarding taking part in presidential polls; although constitution gives him a special permission to contest for the post of president for the second tenure.
Journalist Shahid Orakzai has made clear to commission that the Presidential polls are not allowed to be held in the last days of constitutional tenure of President of Pakistan because these days have been allocated for the transfer of power while commission has set 4 September for polling and the tenure of president is ending on 9th September.
It has been said in the petition that the time set for polling and its possible results can make election controversial and negligence of commission can not be rectified with one stroke of pen so election schedule should be suspended immediately.
