Directed to strictly refrain from making allotment of plots to non-state subject persons:
MIRPUR (AJK), (Parliament Times) : Mirpur Division Commissioner Chaudhry Mukhtar Hussain, while taking notice of public complaints and concerns over reported mushroom growth of various private housing schemes in Mirpur Division, has directed the concerned district administrations to register private housing schemes as per the law and rules and the No Objection Certificate (NOC) should not be issued to these housing societies without town planning, it was officially said.
Our Special Jammu Kashmir state Correspondent Altaf Hamid Rao reports from Mirpur AJK that while chairing a high level meeting, attended by the Deputy Commissioners of all the three districts of Mirpur, Kotli and Bhimbher, besides other related senior officers of the districts and divisional administrations, the Div. Commissioner further directed the Deputy Commissioners that no plots should be allowed to be allotted to any non-state subject person in the housing societies nor the non-state subject persons should be allowed to buy, sell and transfer plots under the prevailing state subject laws.
The Commissioner further directed that In the publicity campaign of the private housing societies, it should be clearly written that “non-state subject persons are not eligible to buy and sell plots”. In this regard, Commissioner Mirpur Division Chaudhry Mukhtar Hussain also instructed the Deputy Commissioners of Mirpur, Kotli and Bhimber to fulfill all legal and constitutional requirements regarding the registration of private housing schemes in their respective districts.
According to the Commissioner Mirpur Division, it had been observed that private housing schemes were being established very rapidly in Mirpur Division. “Due to the unusual publicity campaign by the managements of some of the housing schemes, the public was found expressing concern in the media”, he pointed out.
“It was the primary responsibility of the State functionaries appointed by the government to ensure the protection of the rights of the people of the state”, the Commissioner said. He directed that as the head of the district administrations, the Deputy Commissioners, among other duties, within the limits of their respective districts, should take timely regulatory measures regarding newly established housing schemes so that the investment made by the local residents in private housing schemes should not go unsafe and the people making such investments do not face any problems in the future.
Commissioner Mirpur Division Chaudhry Mukhtar Hussain strictly advised that instructions issued in this regard, should be implemented in letter and spirit.
” It should be ensured that the private housing scheme construction company was registered as per the law, before execution of the construction works in the schemes. “No housing scheme will be allowed to be established without planning (town planning), he categorically ordered the district administrations
“In terms of Section 4 of the Jammu and Kashmir Transfer of Property Act, 1995 (BKRM), no plot in the private housing schemes to be established within the limits of Azad Jammu and Kashmir, will be allowed to be allotted, sold or transferred to any non-state subject person. “Nor any non-state subject person be offered to purchase plots of such schemes”, he advised.
The Divisional Commissioner declared that it will be mandatory for the owners, managements of such private housing schemes to prominently write on the publicity hoardings, advertisements to be published in connection with their advertising campaign that non-state subject residents will not be eligible to purchase plots in such private housing schemes being established in the AJK territory
The Commissioner further directed that it will be mandatory for every housing scheme to allocate space for a mosque in proportion to the residential plots. “It will also be mandatory for every housing scheme to provide space for a graveyard, keeping in mind the future needs. “The managements of only the registered private housing will be bound to construct paved roads within the scheme at its own expense, the width of which will not be less than 30 feet, he directed.
Unveiling further compulosry code of conduct to run the private housing schemes in the division, management of each housing scheme shall be bound to provide electricity at its own expense. The management of each housing scheme shall ensure the supply of sufficient quantum of clean drinking water at its own expense for the expected population determined on the basis of the number of residential plots as per the prescribed standards within the scheme.
