    Grim spectre occurs as furious Khuwja Maqbool talks on judges appointment

    Muzaffarabad,    (Parliament Times)  : Vice Chairman Bar Council Azad Jammu and Kashmir Khawaja Maqbool War Advocate Supreme Court has expressed its concerns over the procedure of appointment of judges in the High Court and said that the President has summarized the appointment procedure of judges and the law. It seems that a systematic effort is being made to implement the appointments of judges through illegal summaries as a result of a deal. The Federal Law Minister should not receive illegal summaries and inform the Chairman Kashmir Council of the real situation and brief them accordingly. The vice-chairman of the Bar Council said in a press release that in the past, judges had been made scapegoats by appointing judges through such illegal summaries and on the other hand, they had been made controversial forever. They want to keep the crisis in the higher judiciary by sending a law against the summary of the appointments of judges. If there is a challenge, there will be a crisis in the judiciary and the judges will become controversial. Earlier, 14 judges have been made scapegoats for such practices. Without trusting the AJK Bar Council, those responsible want to paralyze the higher judiciary by illegally appointing judges in a hasty manner. It will challenge the appointment of judges through illegal summaries. On the other hand, constitutional and legal experts have termed the appointment of judges in the High Court as inappropriate in the last days of the PML-N government in Azad Kashmir. Retired Justice Manzoor Hussain Gilani, Chief Justice of Azad Kashmir, has also written in his articles on the procedure for appointment of judges that the Prime Minister of Azad Kashmir is the supreme leader of the state and the President of the State in carrying out his responsibilities under Article 7 of the Constitution are bound by it. Under Rule 19 C of Schedule 2 of the Rules of Business, it is the responsibility of the Law Department, which is a subordinate body of the Prime Minister, to send proposals to the President for advice on the appointment of judges ever since he introduced the tradition of appointing a person from above as the President of the State to become the Prime Minister, the first revelation in this regard was General Anwar Khan, hence the decline of the judiciary in Azad Kashmir. It kept happening because there were incoherent appointments.

    In principle, appointing judges directly to the Court of Appeal is a wrong decision. It would have been better if the judges who retired from the High Court were brought to the Supreme Court. Experts say that eight new judges are yet to be appointed in the High Court. The government is completing its term. By appointing judges of its own accord, the government is currently paving the way for itself and creating difficulties for the new government, which may lead to fears of compromise on justice.
