ISLAMABAD: A new larger bench of Supreme Court (SC) has been constituted to hear the petitions challenging presidential reference filed against Justice Qazi Faez Isa.
In this new 10-member larger bench those judges have not been included which are part of Supreme Judicial Council nor have the two judges upon whom justice Qazi Faez Isa have raised objection been included in the bench.
When the constitutional petition came up for first hearing earlier before the court, Justice Qazi Faez Isa raised objection over two judges including Justice Sardar Tariq Masood and Justice Ijaz ul Ahsan stating that these two judges are chief justice of future and removal of Justice Qazi Faez Isa will afford direct benefit to them.
The two judges recused themselves from hearing the case and the bench was dissolved.
Chief Justice of Pakistan (CJP) Asif Saeed Khosa has now constituted 10-member bench which will be headed by Justice Umar Ata Bandial. The other members of bench are Justice Maqbool Baqir, Justice Sajjad Ali Shah, Justice Mansoor Ali Shah, Justice Munib Akhtar, Justice Yahya Afridi and Justice Muhammad Amin Ahmad.
This case is being considered very important in the context of independence of judiciary after lawyers movement 2007.
The lawyers organizations have declared presidential reference as based on malafide intent and have demanded of the government to withdraw this reference.
The case will be heard on September 24.
