Review petition once rejected cannot be heard for the second time: CJP


ISLAMABAD:       Chief Justice of Pakistan (CJP) Asif Saeed Khosa has remarked review petition after its rejection cannot be heard for the second time due to legal restrictions.

He further remarked “ precedent on this count is there in its own four decisions of Supreme Court (SC).
CJP gave these remarks while presiding over a 3-member bench of SC during the course of hearing a case of SC Karachi registry through video link Wednesday.
Death convict Rustam Sheikh had filed second review petition in SC Karachi registry.
The court rejected the second review petition of death convict .

The CJP remarked during the hearing of the case the convict can file mercy appeal before the President if he so wills. We cannot hear the review petition for the second time which has been rejected once.

Addressing the lawyer of the convict the CJP remarked “ you have been left with one option that you should again file mercy appeal with the president of Pakistan. If we hear your review petition for the second time then every convict will file review petition again.

Rustam Sheikh had murdered his two relatives in March 1999. The victims were Bashir Ahmad and Haider Bakhsh.

The anti terrorism court Khairpur had awarded death sentence to Rustam Sheikh in October 1999. All the appeals and mercy appeal filed by the convict have been rejected and his death warrants have been issued.
