Lahore: Supreme Court (SC) has declared government employees holding dual nationality a threat to the national interest of Pakistan and ordered federal and provincial governments for enactment of legislation on dual nationality.
A two members bench of SC presided over by the Chief Justice of Pakistan (CJP) Mian Saqib Nisar announced the reserved judgment in the case of judges, government employees and others holding dual nationality Saturday.
The judgment said that officers holding dual nationality cannot be appointed due to national security. Action should be taken against those who have acquired dual nationality for laundering ill gotten money and sending their families abroad after retirement. Such people should be given deadline for giving up other nationality.
The decision said federal and provincial governments should legislate in this regard. The respective governments should give time to such employees either to quit job or give up other nationality.
The governments should give time to abandon citizenship to the employees who have acquired dual nationality during their service tenure and if they don’t do so then proceedings should be initiated against them.
The court maintained in the decision that the government employees holding dual nationality are threat to interests of state of Pakistan.
Permission should be obtained from the cabinet before inducting any Non Pakistani on any post under unavoidable situation. The federal and provincial governments should compile the lists of the employees having dual nationality and put their names in negative list.
A list should be worked out of such posts wherein people having dual nationality cannot be inducted without the approval of cabinet due to national security. The lists of posts in independent and autonomous departments under federal governments should be evolved whereon people holding nationality have been appointed.
It is pertinent to mention here that CJP Mian Saqib Nisar had taken sou motu notice about judges and government employees holding dual nationality and sought record of all officers.
