Islamabad: Islamabad High Court (IHC) has issued the detailed judgment on suspension of punishments awarded to former premier Nawaz Sharif, his daughter Maryam Nawaz and son-in-law captain Safdar in Avenfield reference .
IHC had announced the judgment on September 19 in respect of appeal plea filed against sentences awarded in Avenfield reference to former PM Nawaz Sharif, his daughter and son-in-law. The court had suspended sentences through this Verdict and issued order for setting free these three accused. .
Now on October 3, IHC has issued the detailed ruling in the case consisting of 41 pages.
Judgment has been written by Justice Athar Minallah.
It has been said in the judgment that decision given on bail petition will not affect the appeal pleas filed against conviction .
NAB relied much on panama paper decision for giving arguments in connection with bail pleas.
Accountability Court (AC) didn’t give any reference of assistance to Nawaz Sharif by Maryam Nawaz in apartment’s purchasing.
Also no mention has been made about evidence regarding backing of Maryam in the verdict of AC. It was written in the decision that the punishments awarded to suspects cannot stay longer prima facie’.
Trial Court had acquitted suspects under section 9/A-4 and indicted them under the same section too.
Prosecution didn’t challenge the acquittal of suspects under section 9/A-4.
It has been further said in the judgment that the court findings are not definite as our judgment or observation will not affect the appeals.
It merits a mention here that Accountability Court had sentenced Nawaz Sharif, Maryam Nawaz and captain Safdar 10, 8 and a one year jail term, respectively.
