KARACHI: Sindh High Court (SHC) has declared more than 5 percent increase in their fees by private schools illegal.
A 3-member larger bench of SHC comprising Justice Aqeel Ahmad Abbasi, Justice Muhammad Ali Mazhar and Justice Ashraf Jahan announced the reserved judgment on Monday.
The counsels for parents took the plea that the salaries of the teachers are not even 50 percent of total expenses of the school. The income of the school should also be seen besides its expenses.
According to parents the article 38 of the constitution is applicable to all stake holders. The apex court has already declared it a profitable business.
Sindh government has constituted a committee on the matter regarding increase in the fees of private schools.
Additional Advocate General (AAG) said during the hearing of the case that the matter of enhancement in fees related to fundamental rights and the powers for scaling up fee should rest with the provincial government. While it is not mentioned in the relevant law that the schools are authorized to increase the fee annually.
The larger bench of SHC had reserved the judgment after hearing the arguments.
The court has ruled that the schools are not authorized to increase fee more than five percent.
