Peshawar: A two member bench comprising Justice Qalandar Ali Khan and Justice Muhammad Ayub of Peshawar High Court (PHC) has stayed implementation of death sentence awarded by military court to a citizen of Hangu while suspending the decision of Military Court and summoned reply from Ministry of defence.
As per media reports, Court has issued these interim orders on the plea of the citizen of Hangu Jannat Kareem. The court was informed in connection with this case that the petitioner is under the custody of forces since 2011. A petition was also filed in Peshawar High Court in this regard while Ministry of Defence had also accepted his presence. Despite this the petitioner was awarded the death sentence under the charges of terrorism which carries no justification.
If he was in the custody of forces, than how he committed terrorism while no fair trial took place in Military Court and the petitioner was not even provided to defend himself. Therefore, the death sentence should be nullified.
