‘Raising voice against violation of merit is my constitutional right’: Khalid Ibraheem

Rawalpindi:(Parliament Times) Terming appointment of five AJK High court judges ‘against the merit’ as a matter of serious concern, the member Legislative Assembly Azad Jammu and Kashmir and president Jammu and Kashmir Peoples Party Sardar Ibraheem Khan has said that he had raised his voice against the violation of merit, which he said was his constitutional right being an opposition member in the House.
“It was for the first time in the region’s history that five judges were appointed on political basis and being an opposition legislator I raised the voice in the legislature, which is my constitutional right”, Khan said adding that Supreme Court has no authority whatsoever to issue a notice on the matter. While addressing a press conference here on Monday, JKPP president said that he had expressed his no-confidence over the judiciary saying that whatever he said was nothing out of the ordinary. “I’ve expressed lack of confidence in the courts and this is not something new, it has happened in the past as well”, Khalid Ibraheem said adding that his speech was on record. “I have mentioned names of all those who are responsible and political track record of all five judges appointed in AJK is also available and can be easily checked”, he maintained. Being a member of legislative body he said that it was his moral responsibility to stand against the evil. Khan said that the AJK bar council had constituted a seven member committee but he had informed the committee members that he won’t appear before the courts. Replying to a query he said that he was stick to his stance that issuance of notice and taking suomotu notice against him by the apex court was inaccurate and devoid of any legal justification. JKPP president said that he was not shying away from appearing before the courts but the procedure adopted by the courts was contrary to norms of justice and law. “I talk about the apex court in media because the chief justice supreme court of AJK had sent a notice to me, and he had no authority whatsoever to do so”, Khan said adding that neither he nor any of his representative will appear before the courts on 03 July. He said that he was ready to talk on the issue of any wrongdoing or appointments made against the merit in the past. He said that those who talk on the matter saying there was evidence, they should bring it only then he will respond.
