ISLAMABAD: Islamabad High Court (IHC) has issued stay order in defamation case filed by Ali Mustafa Dar son of former Finance Minister (FM) Ishaq Dar against PTI chairman Imran Khan and stopped sessions judge to proceed further in the case.
A single bench of IHC presided over by Justice Mian Gul Hassan Aurangzeb took up the case for hearing Monday.
Babar Awan advocate appeared in the court on behalf of Imran Khan.
Babar Awan took the plea that all the members of Dar family are absconding. Instead of appearing before the court all the members are in London. Accountability Court (AC) has declared Ishaq Dar absconder. His wife and children have not appeared before the court.
During the course of hearing the learned judge inquired has NAB summoned children of Ishaq Dar. Are the properties of Ishaq Dar are those of Dubai properties.
Counsel for Imran Khan said “ yes, NAB has summoned them several times. HDS tower is Dubai property. Due to non appearance in the court by Ishaq Dar , Supreme Court has suspended his membership of Senate.
Counsel for Imran Khan pleaded how session’s court can run defamation case filed by the person who is absconder and who does not respect courts. The principles of Supreme Court in Ishaq Dar are very clear. The same principles apply to IHC.
The court after hearing the arguments ordered for issuing stay order besides halting the sessions judge from initiating further proceedings.
The court also adjourned the hearing of the case.
