Islamabad: The Supreme Court on Tuesday remarked that National Accountability Bureau (NAB) must provide evidences instead of telling stories as it (NAB) had to meet legal requirements.
A three-member bench headed by Justice Musheer Alam and consisting of Justice Qazi Faiz Esa and Justice Mazhar Alam Khan remarked this during appeal of NAB regarding reopening of Hudaibiya Paper Mills.
At the outset of the proceeding, As the proceedings commenced, Justice Isa asked the NAB prosecutor about the charges against the accused in the case. NAB prosecutor Imran-ul-Haq read out the recommendations of JIT regarding Hudaibia case. He said that record showed Sharif family started money laundering since 1991, adding that accountants were opened in the name of Saeed Ahmed and Mukhtar Hussain. He added that Ishaq Dar statement recorded under Section 164 told it all how the money laundering was done.
Justice Mushir Alam asked the prosecutor whether there was any directive in Panama case regarding Hudaibia. Imran replied that there was no directions regarding the case. Upon this Justice Mushir Alam remarked that then how they would relate it with Panama.
The prosecutor said that Panama JIT had given recommendation regarding Hudaibia. Upon this, Justice Faez Issa said that JIT had given its opinion, asking the NAB law officer to tell the court what criminal offence was committed. He remarked that prosecution was just telling stories, adding that prosecution is required to tell the exact charges against the accused.
NAB prosecutor said that Ishaq Dar had confessed to withdrawing the money in his statement recorded under section 164 of CrPC. Upon this, Justice Mushir Alam said in that case there should have been documents before the court. Justice Issa asked prosecutor to let aside the statements rather produce evidence if the bureau had. He remarked that neither JIT did anything worthy nor he (NAB) did.
He added that Ishaq Dar statement recorded under Section 164 told it all how the money laundering was done. Justice Mushir Alam asked the prosecutor whether there was any directive in Panama case regarding Hudaibia. Imran replied that there was no directions regarding the case.
